1. OBTAINING WORK PERMIT

Work permits for foreign personnel are given by Ministry of Labor and Social Security in accordance with the law numbered 4875. 9ekim completes the application process of the foreign personnel, who will obtain work permit for the first time, in the name of his/her company by preparing and controlling the necessary documents within the prescribed time. The conformity of the criteria of company and expat to the criteria of Ministry of Labor is determined by the experts. Types of Work Permits

Request to extend the work permit is made directly to Ministry of Labor and Social Security with the condition of adding the original of the previous work permit to the documents indicated in Application Regulations and application form. Work permit for a definite time period is given for maximum 1 year to work in a certain business and occupation, according to the time period of work or labour contract and residence permit, considering the situation in work market, developments in business life, sectorial and economic conjuncture changes concerning employment as per the article 5 of the Law Concerning Work Permits of Foreigners numbered 4817.

2. EXTENSION OF THE TIME PERIOD OF WORK PERMIT

After legal working period of 1 year, the work permit can be extended up to 3 years to work in the same business and occupation. However the ministry may interpret the information and documents differently and reject the application because of the situation in work market and incompetency to work permit criteria and when necessary due to sectorial and economic conjuncture conditions and developments in Turkish work market, despite the fact that it is not the first application but the extension of the current work permit. Having a previous work permit does not guarantee the extension of the relevant work permit.

Extension application can be made before the permit expires with the condition that is is made maximum two months before the work permit expires. For the extension of an expired work permit, request petition and attachments must be in the general document records of Ministry of Labor maximum 15 days after the expiration. 9ekim follows the time periods with the softwares peculiar to the company and reminds the HR departments. 3. WORK PERMIT APPLICATION IN TURKISH CONSULATES ABROAD

4. OBJECTION TO REJECTED WORK PERMIT

• That the situation in work market and developments in business life, sectorial and economic conjuncture changes concerning employment are not convenient for work permit
• That there is a person who has the same qualities to do the said work in the country within 4 weeks
• That the same person applies for the same business, company or position within 1 year after the rejection of the first application
• That it constitutes a threat for national security, public order, public peace, common good, public moral and public health
• That it is later determined that incomplete or inaccurate information has been provided
• That the residence permit of the foreigner has become invalid for any reason or not been extended
• That the passport or the document replacing passport has not been extended
• That the foreigner has stayed abroad for more than 6 months continuously except the force majeure
• That it does not meet the application criteria of the Ministry

Ministry may reject the application for work permit or extension of work permit for the reasons listed below despite detailed analyse, laws and criteria. If an application is rejected, no applications can be made by the same person for 1 year and possible later applications can be affected negatively by the fact that the previous one was rejected.

Ministry issues its decision of rejection as per the provisions of Notification Law numbered 7201. The company can object to the decision within 30 days starting from the date of notice. If the objection is rejected by the Ministry, one can go for administrative jurisdiction.

When required by the situation in work market and developments in business life, sectorial and economic conjuncture changes concerning employment, certain sectors may be limited and therefore work permit or extension application may be rejected.

5. CONSULTANCY FOR GENERAL WORK PERMIT

6. SERVICES FOR ENDING WORK PERMIT

It is a legal obligation to end the transactions in the relevant institutions if the foreigner wants to return to his/her country or the work permit is not extended. 9ekim provides these services within legal time period.

7. SERVICES FOR THE COMPANIES IN FREE ZONES

9ekim provides professional services to foreign personnel to be employed in any free zone in Turkey for obtaining work permit within 15 days.

“Foreign Personnel Application Form” and its attachments must be sent to the Undersecretariat in order to get work permit for foreign personnel to be employed in free zones.

If the applicant is the owner or the partner of the company, there is no need for translation and copy of diploma.

In order to extend work permit, you need to apply to District Office with;

• A petition

• Foreign Personnel Application Form

• The original of the current work permit

• 7 photos

• Copy and translation of the valid passport approved by notary

Except that the applicant is the owner or the partner of the company, the foreigner must be executive or qualified personnel. The expertise of the relevant person must be documented with diploma, or else certificate or references from previous companies, for which the relevant person worked, must be submitted.

For requests of employment foreign personnel, the users must employ the same number of Turkish workers stated in Operating Licence Application Form.

If the user would like to employ foreign personnel more than that which stated in Operating Licence Application Form, the reasons must be explained to the Undersecretariat.

If it is determined that the foreign personnel, who has obtained work permit, has not started to work or insurance register has not been made, work permit is cancelled and Ministry of Internal Affairs is informed for residence permit also to be cancelled.

If it is determined that the foreign personnel is working in Turkey with work permit given for working in free zone, Operating Licence of the user which employs the relevant person is cancelled.

The user is responsible for Work Permit and keeps it during the employment of the relevant person. If it is lost for any reason, it is necessary to inform the Undersecretariat urgently. Also if the relevant person has left work or his/her work permit has been cancelled, the original of work permit must be returned to the Undersecretariat by the relevant user within 1 week.

8. OBTAINING WORK PERMIT FOR FOREIGN MAIDS, SERVANTS, CAREGIVERS, NURSEMAIDS, NURSES

Starting from 1st of February 2012, foreigners, who work illegally as maids, servants, caregivers, nursemaids, nurses in Turkey on 3 months’ tourist visa, are to leave Turkey after 90 days and cannot return before staying abroad for 90 days if they do not have current residence in Turkey.
